These Terms of Service govern access to and use of the Korsica platform. By registering, listing a vehicle, or placing a bid, the User represents that they have read, understood, and fully accepted these terms.
To create a Korsica account the User must be of legal age (18 years or older) and have the legal capacity to enter into contracts under Mexican law. The User agrees to provide truthful, complete, and current information.
To bid or sell, the User must complete the identity verification (KYC) process, which may include capture of official ID, selfie with liveness check, proof of address and, for legal entities, additional corporate documentation. Korsica reserves the right to reject or suspend any account that fails to verify identity or shows signs of fraud.
Each Auction has a published duration (typically 7 days). Bidders place binding offers using minimum increments set by Korsica. Every Bid is an irrevocable offer to purchase at the stated price plus the applicable Commission.
Late-bid extension: if a Bid is placed during the final two (2) minutes before Auction close, the end time will automatically extend by two (2) additional minutes to allow competing responses. This extension will repeat as many times as necessary until two minutes pass without any new Bids.
Reserve price: some Auctions are listed with a Reserve. If the winning Bid meets or exceeds the Reserve, the sale is considered closed and binding on both parties. If the winning Bid is below the Reserve, the Post-auction section applies.
Upon bidding, Korsica may place an authorization hold on the Bidder's card for the Bid amount and/or a security deposit. If the Bidder does not win, such hold is released; if the Bidder wins, it is applied to the Commission and/or vehicle payment as applicable.
Buyer's Premium: Korsica charges the winning Bidder a commission equal to three percent (3%) of the final price, with a minimum of $3,000 MXN and a maximum of $75,000 MXN. This commission is added to the hammer price and paid to Korsica.
Seller listing fee: the standard listing for private Sellers is free. Korsica may offer premium packages (professional photography, assisted copywriting, featured exposure) with fees published at the time of purchase.
All prices and fees are denominated in Mexican pesos (MXN) unless otherwise indicated and exclude VAT where legally applicable.
If at Auction close the winning Bid is below the Reserve, Korsica will open a twenty-four (24) hour negotiation window between the Seller and the highest Bidder. During that window the Seller may accept the bid, reject it, or send a counter-offer; the Bidder may accept or decline the counter. If neither party accepts within the window, the Auction closes without sale and Korsica releases any card authorizations.
Korsica acts solely as a technology platform that facilitates the match between Sellers and Bidders. Korsica is not a party to the vehicle sale, does not transfer ownership, assumes no warranties regarding eviction or hidden defects, and offers no guarantee on the mechanical, electrical, cosmetic, or documentary condition of the vehicle, except for express guarantees Korsica may choose to offer in writing for a specific listing. The Bidder acknowledges that purchase of a used vehicle is "as-is" and agrees to perform whatever due diligence they deem necessary.
All elements of the Platform (brand, logo, code, design, curatorial text, and databases) are the property of Korsica or used under license, and are protected by Mexican and international law. By uploading photos, videos, or descriptions of their vehicle, the Seller grants Korsica a worldwide, non-exclusive, royalty-free, transferable license to store, reproduce, adapt, and display such content on the Platform and in marketing materials related to the Auction and the public price history.
The processing of personal data is governed by our Privacy Notice, drafted in accordance with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties.
Korsica may modify, suspend, or discontinue the Platform in whole or in part, and may update these Terms. Material changes will be notified to the User by email and/or via visible notice on the Platform at least fifteen (15) days in advance. Continued use of the Platform after the effective date constitutes acceptance of the new Terms.
These Terms are governed by Mexican federal law. For interpretation and enforcement, the parties expressly submit to the jurisdiction of the competent courts of Mexico City, waiving any other forum that may correspond to them by reason of their present or future domicile. The foregoing is without prejudice to the rights granted to the User by the Federal Consumer Protection Law before PROFECO.
